New Arizona Real Estate Laws Taking Effect September 12: What Homeowners Should Know
Several new Arizona laws affecting homeowners, buyers, sellers, and HOAs take effect September 12, 2026. Here are a few key changes worth knowing.
🏘️ HOA Resale Disclosures Are Changing
HB 2397 updates the resale disclosure process for Arizona planned communities and condominiums, including when certain HOA documents must be provided during a sale.
Why it matters: Buyers in HOA communities may receive important association information earlier in the transaction, helping them better understand fees, assessments, and community rules before closing.
☀️ More Flexibility for Backyard Shade
HB 2342 limits an HOA’s ability to prohibit backyard shade structures, although associations may still establish certain reasonable requirements regarding size, placement, and appearance.
Why it matters: Arizona homeowners have greater flexibility to add much-needed backyard shade while still following applicable community guidelines.
🛡️ Stronger Protections Against Deed Fraud
SB 1479 strengthens protections against fraudulent property filings, including identification requirements for certain in-person recordings and increased penalties for knowingly recording certain false or forged real-property claims.
The law also requires county assessors to establish an opt-in notification system by January 1, 2027, alerting property owners when certain ownership or mailing-address changes are reported.
Why it matters: These measures provide Arizona property owners with additional safeguards against deed and title fraud.
🏢 Greater Protection for Condominium Owners
SB 1246 raises the thresholds for when certain condominium association liens may be foreclosed—from one year to 18 months of delinquency and from $1,200 to $10,000 in delinquent assessments.
Why it matters: Condo owners facing unpaid assessments have additional protection before an association can pursue foreclosure, although the assessments themselves remain due.
